Daniel Hernandez was shot by Toni McBride back on April 22, 2020.

Officer Toni McBride of the Los Angeles Police Department arrived at the site of an automobile accident in the city’s Newton patrol district. The individual who caused the collision was possibly suicidal, according to a 911 caller, and was cutting himself in the roadway.

Daniel Hernandez was found appearing bewildered, meandering across traffic, and clutching an item at his side when McBride arrived on the scene.

Hernandez looked to be standing at a safe distance of roughly 30 feet from McBride in footage from her body camera. McBride then told Hernandez to “drop the knife” before shooting him six times. However, the “knife” turned out to be a box cutter according to The Appeal.

Los Angeles Police Commission ruled Toni was not justified in firing him six times to Hernandez, but the body ruled her initial shots were justifiable. However,  her first four shots were justified, but everything fired after that, including shots fired while Hernandez was already on the ground, violated department policy according to Los Angeles Magazine.
